If anyone thinks there are going to make a living submitting mobile apps via mobile marketplace for windows or via the others such as iTunes, the Blackberry store, etc then I would say go buy some lottery tickets and it would be easier. The limitation of 10mb vs 100mb makes absolutely no difference to me as a developer. I am more concerned about marketing, promotion, an easy process for app certification, etc.

Yes,

We used OpenGL ES because Direct3D Mobile is just a wrapper around OpenGL. We also used some hardware-specific extensions only exposed in OpenGL.

Well, how do the touch patents relate to computer mouse patents? I believe the mouse was initially patented as well and we all do easily use one today (tried to read that up on Wikipedia, but many different mouse patents seemed to intersect over the years). And I couldn't imagine Apple preventing a whole generation of devices just because of patents. They'll make their cut and that's about it ergo licensing.
